1. Quote Validity – All quotes are valid for 30 days from the date of issuance unless accepted sooner by the customer.

 

2. Property Authorization – The customer confirms that they are the legal property owner or have written authorization from the landowner for services to be performed on the property.

 

3. Site Preparation – The work area must be free of debris and hazards, including but not limited to tires, wire fencing, trash, and other obstructions. If such hazards are present and must be removed by the service provider, a “Debris Charge” will be added to the final invoice. The customer is responsible for disclosing utilities, septic systems, irrigation lines, and other hidden hazards
Failure to Disclose Utilities or Hazards: Kuhbander Land Clearing & Forestry Mulching LLC is not responsible for any damage resulting from unmarked or undisclosed utilities or obstacles. Repair costs are the responsibility of the property owner.

 

4. Payment Terms – Final payment is due upon job completion. A deposit of 10% or $250 (whichever is greater) is required upon acceptance of the quote. Payments made by credit or debit card are subject to an additional 3% processing fee.

 

5. Refund Terms - Deposits are refundable if cancellation occurs 14+ days before the scheduled start date.
Deposits are non-refundable if cancellation occurs within 14 days of the start date

 

6. Property Impact – Due to the use of heavy equipment, some turf or ground disturbance may occur. While every effort will be made to minimize damage, the customer acknowledges that some level of impact is unavoidable. Kuhbander Land Clearing & Forestry Mulching LLC is not liable for cosmetic or incidental damage to lawns, soil, turf, or vegetation during standard operations.
Customer assumes responsibility for natural changes in terrain resulting from clearing or grading services.

 

7. Safety Requirements – For safety reasons, all people and animals must remain at least 300 feet away from machinery while it is in operation.

 

8. Weather Conditions – Services are weather dependent and may be rescheduled or delayed in the event of unsafe or unsuitable conditions. Deposits will not be forfeited if Kuhbander Land Clearing & Forestry Mulching LLC initiates rescheduling.

10.  Service Limitations & No Warranty - All services are provided "as-is" with no warranties, unless stated in writing.
Kuhbander Land Clearing & Forestry Mulching LLC does not guarantee results impacted by weather, land conditions, wildlife, or natural regrowth.

 

11. Governing Law & Dispute Resolution - These Terms are governed by the laws of the State of Michigan.
Any disputes will be resolved in the courts of St. Joseph County, Michigan.
